Relasi Kekuasaan Presiden dan DPR dalam Sistem Presidensial

Abstract

Tulisan ini membahas relasi Presiden-DPR selama satu dekade kepemimpinan Presiden SBY yang acap terjebak dalam ketegangan antarlembaga disebabkan oleh desain dari koalisi, lemahnya karakter institusional partai di DPR, dan persepsi diri DPR jika berhadapan dengan presiden tanpa perlu menyebabkan terjadinya konflik atau sampai terjadinya krisis pemerintahan. Kenyataan ini terjadi karena kepemimpinan Presiden SBY yang akomodatif, karakter institusional partai yang masih lemah, dan konstruksi konstitusi serta peraturan perundang-undangan seperti persetujuan bersama dan mekanisme rapat konsultasi presiden dan Pimpinan DPR yang dapat dijadikan solusi untuk mencairkan situasi ketegangan antarlembaga tersebut. Boleh dikata, faktor-faktor tersebut yang menjelaskan realitas dari keberhasilan kepemimpinan SBY dalam satu dekade. Untuk itu, penulis menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus yang bersifat instrumental. Selanjutnya, untuk memahami konsep sistem presidensial dan implikasinya, maka, penulis menggunakan perspektif teori yang melatarinya, yakni teori pembatasan kekuasaan, sistem presidensial, dan kombinasi sistem presidensial dan multipartai.

This article discusses the powers of the President-Parliament relations in a decade leadership of the president SBY, who often get caught up in the tension between institutions caused by the design of the coalition, weak character of the institutional parties in the Parliament, and self-perception of the Parliament dealing with President but did not lead to conflict or until occurrence of a government crisis this occurs because the leadership of President SBY accommodative, institutional character of the party is still weak, and construction of the constitution and legislation such as collective agreements and mechanisms of consultation meetings the President and Chairman of the Parliament to be the solution to diffuse the situation of inter-institutional tensions. These factors that explain the reality of the SBY leadership succes in a decade. Underlying theory perspective is the theoritical limitation of power, the presidential system, and combination and multi-party presidential system; to comprehend the concept of a presidential system and its implications.
